Charges such as reckless driving, misdemeanor failure to perform the duties of a driver (hit and run property damage), and criminal mischief in the second degree have fewer required penalties than the crime of DUII. When convicted of one of these charges, you can expect a sentence of probation, a fine, an order of restitution if applicable, and at least a 90 day license suspension. Jail time is possible though not required. The amount of jail time, if any, will depend primarily on the seriousness of the incident and the defendant's driving record.
